Ambershore Pix Limited (company number 13063077), VAT number: GB374692851, registered office 5th Floor, 167-169 Great Portland Street, London, W1W 5PF (“we”, “us”, “our”), provides property photography and related visual-marketing services. Contact: hello@ambershorepix.co.uk; 0800 999 1577. “Ambershore Pix”™ is a trade mark used by us.
These Terms apply to (a) use of our website ambershorepix.co.uk (the Site) and (b) all bookings for our Services. Please read them before booking. If you do not agree, please do not use the Site or book our Services.
Version: September 2026
1. Definitions
Booking Request means an enquiry or request you submit (via the Site enquiry forms, our client booking portal, WhatsApp, email, telephone or otherwise) asking us to provide Services.
Booking Confirmation means our written communication (by email or through the booking portal) confirming that we accept a Booking Request.
Business Customer means a customer acting wholly or mainly for purposes relating to a trade, business, craft or profession (for example estate agents, letting agents, property managers, developers, landlords acting commercially, and hospitality or serviced-accommodation operators).
Consumer means an individual acting wholly or mainly outside their trade, business, craft or profession (for example a private homeowner selling or letting their own home).
Contract means the contract between you and us formed under clause 5, comprising these Terms and the applicable Quotation and/or Booking Confirmation.
Deliverables means the photographs, videos, floor plans, lease plans, virtual tours, CGI/virtually staged images, EPC outputs and other materials we produce.
Fees means the charges for the Services.
Quotation means the written quote we send you before you book, setting out the Services and the price. Quotations state prices exclusive of VAT; for Consumers they also state the total including VAT (clause 8).
Services means the services described in the Quotation and/or Booking Confirmation.
Business day means any day other than a Saturday, Sunday or bank holiday in England and Wales.
2. Application and scope
2.1 These Terms apply to the Contract to the exclusion of any other terms you seek to impose and, for Business Customers, any terms implied by trade, custom, practice or course of dealing.
2.2 For Business Customers, the Contract is the entire agreement between us, and you acknowledge that you have not relied on any statement or representation not set out in it. Nothing in this clause limits liability for fraud or fraudulent misrepresentation.
2.3 Nothing in these Terms affects a Consumer’s statutory rights. Where any term conflicts with a Consumer’s non-excludable statutory rights, those rights prevail.
3. Interpretation
Headings are for convenience only. The singular includes the plural and vice versa. “Including” means “including without limitation”.
4. The Site and electronic communications
4.1 Site content is provided for general information. Sample galleries and portfolio images illustrate our work and are not a promise that your Deliverables will be identical.
4.2 You may not misuse the Site, attempt unauthorised access, or use it unlawfully.
4.3 The Site and our booking portal use third-party providers, including website hosting, the booking system, mapping and address look-up, email, cloud storage and hosted virtual-tour platforms. Their processing of personal data is addressed in clause 18 and our Privacy Policy.
5. How a booking is made and when the Contract is formed
5.1 A Booking Request, including any request submitted through the Site enquiry forms, the client booking portal, WhatsApp, email or telephone, is an offer by you (or, where we have quoted, your acceptance in principle) and does not by itself create a contract.
5.2 Where you use the client booking portal, submitting a slot creates a pending appointment only. It is a request to book and is not confirmed until we issue a Booking Confirmation or approve the appointment.
5.3 No Contract is formed until we issue a Booking Confirmation or, if earlier, we begin performing the Services with your agreement. We are not obliged to accept any Booking Request.
5.4 Before you are bound, we will make available the information required by law, including a description of the Services, the total price and VAT position (clause 8), the expected timescale, cancellation information, and our identity and contact details. For distance and off-premises contracts with Consumers, we will provide this and confirm the Contract on a durable medium, by email.
5.5 If any information you provide is incorrect, please tell us promptly so we can correct it before the Contract is formed.
6. The Services
6.1 We will provide the Services with reasonable care and skill and, so far as reasonably practicable, in accordance with the Quotation and/or Booking Confirmation.
6.2 We may make changes needed to comply with law or safety requirements, or minor changes that do not materially reduce the quality of the Services, and will notify you.
6.3 We use reasonable endeavours to meet agreed dates and turnaround times. For Business Customers, time is not of the essence. For Consumers, where no time is fixed we will perform within a reasonable time.
6.4 Deliverables involving creative and editorial judgement, such as framing, styling, editing and colour treatment, reflect our professional style. Subjective dissatisfaction with style, where the Services were performed with reasonable care and skill, is not a defect.
7. Your obligations
7.1 You must, at your own cost, provide safe and timely access to the property at the agreed time, ensure the property is ready to be photographed (tidied or staged as you require), and obtain all necessary permissions and consents, including from owners, occupiers, tenants, building managers and any freeholder or managing agent, for us to attend and to capture and use images of the property and its common parts.
7.2 You confirm that you are entitled to instruct the Services in respect of the property and that our attendance and image capture will not breach any third party’s rights.
7.3 Where people may appear in images, you are responsible for informing occupiers and tenants in advance. We will take reasonable steps to avoid capturing identifiable individuals but cannot guarantee this on site.
7.4 If you do not meet clauses 7.1 to 7.2 and this prevents or delays the Services, clause 10 (wasted visits) may apply, and we are not liable for the resulting delay or non-performance.
8. Fees, VAT and expenses
8.1 Fees are as set out in the Quotation or the price shown when you book. Prices displayed as “from” indicate a starting price. The applicable price depends on property size, location, service combination and requirements, and is confirmed in the Quotation and/or Booking Confirmation.
8.2 Order of documents. We send you a Quotation before you book. If you accept it and we issue a Booking Confirmation, the Contract is formed at the price in that Quotation. We invoice after the Services have been carried out, in accordance with clause 9. The invoice applies VAT to the quoted price and confirms the amount payable. It does not introduce any charge that was not disclosed before the Contract was formed.
8.3 VAT – general. We are registered for VAT. Unless expressly stated otherwise, all prices shown on the Site, in our price lists, in the booking portal and in our Quotations are exclusive of VAT, and VAT at the applicable rate (currently 20%) is applied on invoice. Every invoice shows our VAT registration number, the net amount, the VAT rate and amount, and the total payable.
8.4 VAT – Consumers. If you are a Consumer, your Quotation will state both the price excluding VAT and the total price including VAT, so that you know the full amount payable before you book. Where the price genuinely cannot be calculated in advance, for example because it depends on property size or location, we will tell you how it will be calculated and confirm the total inclusive price before the Contract is formed. No VAT or other charge will be applied to a Consumer’s price for the first time at invoice stage.
8.5 Additional charges. Any charge beyond the price quoted, for example additional services under clause 8.7 or the charges in clause 10, requires your agreement. For Consumers, we will not charge any sum that was not disclosed to you before the Contract was formed or expressly agreed by you afterwards.
8.6 For Business Customers, Fees may be quoted on a time-and-materials basis and we may, where stated in the Quotation, recover reasonable pre-agreed expenses such as travel, parking, congestion and ULEZ charges and third-party costs, plus VAT.
8.7 Additional services not in the original Quotation will be charged at our applicable rates plus VAT and agreed with you before we carry them out.
9. Payment
9.1 Unless otherwise agreed in writing, Fees are invoiced on completion of the Services or on the dates set out in the Quotation. We may require a deposit or advance payment, which will be stated before booking.
9.2 Business Customers must pay within 7 days of the invoice date, or any agreed credit terms. Time for payment is of the essence. If a Business Customer pays late, we may charge statutory interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998, being interest at 8% above the Bank of England base rate plus fixed compensation and reasonable recovery costs, and we may suspend Services and withhold Deliverables until payment is received. A Business Customer may not withhold or set off any amount.
9.3 Consumers pay as stated at booking, for example a deposit on booking and the balance on or before delivery, at the total inclusive price confirmed under clause 8.4. If a Consumer pays late, we may charge reasonable interest at 4% above the Bank of England base rate on overdue sums. Consumers retain all set-off and other statutory rights.
9.4 All payments are in British Pounds Sterling unless we agree otherwise in writing. Receipts are issued on request; VAT invoices are issued as a matter of course.
10. Changes, rescheduling and cancellation by you
10.1 If you want to change or reschedule a booking, tell us in writing as soon as possible. We will use reasonable endeavours to accommodate changes; additional work is chargeable under clause 8.7.
10.2 We ask for at least 24 hours’ notice to cancel or reschedule an appointment.
10.3 Business Customers. If you cancel or reschedule with less than 24 hours’ notice, a cancellation and administration fee of £25 plus VAT applies. If we attend at the agreed time and the shoot cannot proceed because access is denied, the property is not ready, or the appointment is cancelled on arrival, we may charge 50% of the quoted shoot Fee plus VAT, to cover our reserved time, travel and lost opportunity, in addition to the £25 plus VAT fee. These sums are a genuine pre-estimate of our loss.
10.4 Consumers – statutory cancellation right (cooling-off). If you are a Consumer and the Contract is a distance or off-premises contract, you have the right to cancel within 14 days of the day the Contract is formed, without giving a reason, using clause 12 and the form in the Schedule. Bookings made through our website, booking portal, email, telephone or WhatsApp are distance contracts, so this right will normally apply.
10.5 Consumers – late cancellation outside or after the cooling-off period. If your statutory cancellation right does not apply or has ended, and you cancel or reschedule with less than 24 hours’ notice, or we cannot proceed on arrival for a reason within your control, we may charge a reasonable amount reflecting our actual and reasonably foreseeable loss, being our reserved time, travel and wasted costs. This will not exceed the equivalent of the charges in clause 10.3, that is £25 plus VAT (currently £30 including VAT at 20%) and, where we have attended, 50% of the quoted shoot Fee plus VAT. These amounts will be stated to you inclusive of VAT before you book, and will not be applied where the cause was outside your reasonable control.
11. Changes and cancellation by us; unforeseen events on the day
11.1 If camera or equipment failure, inclement weather (particularly for exterior and drone work), or other circumstances we could not reasonably avoid prevent us shooting on the scheduled date, we will offer a new date or, if you prefer, refund any deposit or advance payment for the affected Services.
11.2 If we must change the Services or how they are provided due to circumstances beyond our reasonable control, we will notify you promptly and keep changes to a minimum.
12. Refunds, remedies and Consumer cancellation
12.1 Consumer statutory remedies. If Services are not carried out with reasonable care and skill, Consumers are entitled to the remedies in the Consumer Rights Act 2015, including repeat performance and, where applicable, a price reduction. Nothing in these Terms limits those remedies.
12.2 Consumer cooling-off cancellation and refunds. Where clause 10.4 applies, you may cancel at any time within the 14-day period without giving a reason. To cancel you need only tell us clearly that you have decided to cancel, by email to hello@ambershorepix.co.uk, or by using the model form in the Schedule if you prefer. You do not have to use the form, and your cancellation is in time if you send it before the period ends. We will refund all payments you have made, including VAT, without undue delay and in any event within 14 days of the day we are informed of your decision. We will refund using the same means of payment you used, unless you expressly agree otherwise, and we will not charge you any fee for making the refund. Where you asked us to begin before the period ended and you owe us a proportionate payment under clause 12.3, we may set that amount off against the refund.
12.3 Early performance during the cooling-off period. Many bookings are for an appointment falling within the 14-day period. We will not begin the Services before that period ends unless you expressly ask us to; for off-premises contracts your request must be on a durable medium, and we provide a tick-box for this. If you then cancel before the Services are complete, you must pay for what we have supplied up to the point we are informed of your decision to cancel, in proportion to the Contract as a whole, calculated on the basis of the total price agreed. You will owe nothing for anything supplied during the cancellation period if you did not make that express request, or if we failed to give you the required information about your cancellation right and about paying for early performance. If you expressly requested early performance and acknowledged that you would lose your cancellation right once the Services are fully performed, you will not be able to cancel once we have fully performed, that is once the shoot has been completed and the Deliverables supplied.
12.4 Deposits and digital Deliverables. Deposits are refundable in the circumstances in clause 11.1 and clause 12.2. Because Deliverables are bespoke digital content produced for you, once they have been fully performed and supplied following your express request and acknowledgement under clause 12.3, they are not returnable and the Fee for completed, conforming Services is not refundable. This does not affect your rights where the Services were not performed with reasonable care and skill (clause 12.1) or any other non-excludable statutory right.
12.5 Non-attendance. If you fail to attend or provide access at the agreed time, outside any subsisting cooling-off cancellation, the Fee for the reserved appointment is chargeable in accordance with clauses 10.3 and 10.5.
13. Intellectual property and ownership of copyright
13.1 We own, and retain, all copyright and other intellectual property rights in the Deliverables. You do not acquire ownership of copyright; you acquire the licence in clause 14.
13.2 We retain all rights to raw and unedited files, project files and CGI source files, which are not part of the Deliverables and are not supplied unless separately agreed in writing.
14. Licence to use the Deliverables
14.1 Conditional on full payment of all Fees due, we grant you a non-exclusive, perpetual, worldwide, royalty-free licence to use the delivered Deliverables for marketing the specific property they depict, including uploading to property portals such as Rightmove, Zoopla and OnTheMarket; your own website and social media; brochures and listing particulars; and sharing with the owner or developer and with third-party marketing suppliers acting for that listing.
14.2 The licence includes the right to sub-license to portals and marketing suppliers only for marketing that property. It does not permit resale or licensing of the Deliverables as stand-alone content, use unconnected with the property, or registration of any right in the Deliverables.
14.3 Until full payment, any use of the Deliverables is unlicensed. If the Contract terminates for your material breach or non-payment, the licence does not arise or, if already granted, may be suspended until the breach is remedied.
14.4 You must not remove any copyright notice or credit we reasonably apply. You may make minor edits such as cropping or resizing for a portal, but must not materially alter the Deliverables in a way that misrepresents the property (see clause 15.5) or subjects them to derogatory treatment.
14.5 AI and data. You must not use the Deliverables, and must not permit others to use them, to train, fine-tune or develop artificial-intelligence or machine-learning models, without our prior written consent.
14.6 Portfolio use by us. We may use non-confidential Deliverables and behind-the-scenes material to promote our business, including portfolio, website, social media and awards, except that for images a Consumer commissioned for private and domestic purposes we will obtain your consent before public use (see clause 15.4), and we will not use images in a way that discloses occupiers’ personal information. You may ask us in writing not to feature an identifiable property and we will comply going forward.
15. Service-specific terms
15.1 Drone and aerial work. Drone flights are subject to Civil Aviation Authority requirements, including UK Regulation (EU) 2019/947, the Air Navigation Order 2016 and CAP 722, covering Operator ID and Flyer ID and any required certification, flight-restriction zones, and congested-area and safety rules. We, or our subcontractor, will hold the appropriate permissions and insurance. If a lawful and safe flight is not possible on the day, for example due to airspace restrictions, weather or refusal of permissions, we will not carry out the aerial element and clause 11.1 applies to that element.
15.2 Floor plans and lease plans. Floor plans are marketing plans, not measured surveys. Areas and dimensions are approximate and prepared to normal marketing tolerances and, where relevant, on an IPMS or RICS-style basis, and should not be relied on for structural, conveyancing or valuation purposes. Where you order lease plans for HM Land Registry purposes, they will be prepared to be compatible with HM Land Registry requirements (Practice Guide 40, Supplement 2) provided you give us accurate title and extent information. We are not responsible for HM Land Registry requisitions caused by information you supply.
15.3 Virtual tours and 3D – hosting. Virtual tours are hosted on a third-party platform. Hosting for a period of 3 months from the date of delivery is included in the Fee. After that period, continued hosting is not included and may be arranged by separate agreement at a fee to be agreed between us. We will give you reasonable notice before the included hosting period ends. If continued hosting is not agreed, the tour and any embedded links or QR codes may cease to work after the included period. Continued availability during the hosting period depends on the third-party platform.
15.4 Private commissions. If you are a Consumer commissioning photographs or film for private and domestic purposes, you have the right under section 85 of the Copyright, Designs and Patents Act 1988 to prevent copies being issued, exhibited or communicated to the public. We will not publish such images, including for portfolio use, without your consent.
15.5 CGI and virtual staging – disclosure. Virtually staged and CGI images are digitally created or altered and do not depict the actual current state of the property. When such images are used in marketing they must be clearly labelled as virtually staged, computer-generated or digitally altered. You are responsible for ensuring this disclosure appears wherever you publish them, so that marketing is not misleading under the Digital Markets, Competition and Consumers Act 2024. We will label the files accordingly on delivery.
15.6 EPCs. Domestic EPCs are produced by an accredited domestic energy assessor and lodged on the national EPC register as required by the Energy Performance of Buildings (England and Wales) Regulations 2012. The assessor’s professional and statutory duties, including impartial assessment and lodgement, cannot be waived or contracted away, and the EPC rating reflects the assessment methodology, not our or your preference. You must give accurate access and property information.
16. Our liability
16.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; breach of the terms implied by the Consumer Rights Act 2015 that cannot be excluded; or any other liability that cannot lawfully be excluded.
16.2 Consumers. We are responsible for loss or damage that is a foreseeable result of our breach or negligence. We are not liable for loss that is not foreseeable, or for loss arising when we are acting under a Consumer’s instructions. We do not exclude or limit liability in any way not permitted by law.
16.3 Business Customers. Subject to clause 16.1, we are not liable for indirect or consequential loss, loss of profit, loss of business, loss of anticipated savings, loss of data or loss of goodwill; and our total liability arising under or in connection with the Contract, whether in contract, tort including negligence, breach of statutory duty or otherwise, is limited to the total Fees payable under the Contract. This allocation of risk is reflected in the Fees and is reasonable under the Unfair Contract Terms Act 1977.
16.4 We are not liable for delay or failure caused by your breach of clause 7, or by circumstances under clause 21.
17. Indemnity (Business Customers only)
17.1 A Business Customer must indemnify us against losses, damages, claims, costs and expenses we suffer arising from damage to our or third parties’ equipment caused by the Business Customer, its agents or employees, and any third-party claim arising from the Business Customer’s lack of authority or permissions under clause 7 or its use of the Deliverables in breach of clause 14 or 15.5. This clause does not apply to Consumers.
18. Data protection
18.1 Each party will comply with the UK GDPR and the Data Protection Act 2018, as amended, including by the Data (Use and Access) Act 2025.
18.2 For most personal data we handle in connection with the Services, including your contact and booking data, correspondence, invoicing and payment records, and our own marketing, we act as an independent controller, not as your processor. Where you and we each determine our own purposes for personal data we exchange, we each act as separate, independent controllers.
18.3 Where images or floor and lease plans incidentally capture personal data, for example an identifiable occupier or personal items, we act as controller in creating the Deliverables and you act as controller for your own marketing use of them. You are responsible for informing occupiers and tenants as set out in clause 7.3.
18.4 For EPCs, the assessor and accreditation scheme process and lodge data as required by law (clause 15.6).
18.5 In the rare case where we genuinely process personal data solely on your documented instructions and on your behalf, we will enter into Article 28 UK GDPR processor terms for that processing.
18.6 How we handle personal data, including access and key-safe information, third-party providers such as the booking system, hosting, email, cloud storage, mapping and virtual-tour hosts, retention and your rights, is set out in our Privacy Policy. If there is any conflict between these Terms and the Privacy Policy on data-protection detail, the Privacy Policy prevails, subject to applicable law.
19. Termination
19.1 We may suspend or terminate the Services immediately by notice if you materially breach the Contract and, where capable of remedy, fail to remedy within a reasonable time; or fail to pay any amount when due.
19.2 In addition, for Business Customers we may terminate immediately if the Business Customer becomes insolvent, is unable to pay its debts, enters any arrangement with creditors, or has an administrator, receiver or liquidator appointed, or steps are taken towards any of these, under the Insolvency Act 1986.
19.3 Termination does not affect accrued rights. Clauses 8 to 9, 13 to 18 and 22 to 28 survive termination.
20. Subcontracting and assignment
20.1 We may subcontract or delegate performance, for example to freelance photographers, drone pilots or energy assessors, and may assign or transfer our rights and obligations, provided your rights under the Contract are not adversely affected. We remain responsible for the Services.
20.2 A Business Customer may not assign or subcontract its rights or obligations without our written consent. A Consumer may transfer the benefit of any statutory guarantee or the Contract as permitted by law.
21. Events beyond reasonable control
21.1 Neither party is liable for failure or delay caused by events beyond its reasonable control, including industrial action, civil unrest, fire, flood, storms, extreme weather, epidemic or pandemic, acts of terrorism or war, and governmental action. The affected party will notify the other. If the event continues for 90 days, either party may cancel the affected Services, and we will refund any advance payment for Services not provided.
22. Complaints
22.1 If you are unhappy, please contact hello@ambershorepix.co.uk and we will try to resolve matters promptly. This does not affect your statutory rights.
23. Third-party rights
23.1 The Contract does not create rights under the Contracts (Rights of Third Parties) Act 1999 for anyone who is not a party, except that permitted sub-licensees under clause 14 may rely on the licence granted.
24. Notices and communications
24.1 Notices must be in writing. Notices to us should be sent to hello@ambershorepix.co.uk or our registered office. Notices to you will be sent to the contact details you provided. Email notices are deemed received on the next business day after sending, unless a delivery-failure message is received.
25. No waiver
25.1 A delay or failure to enforce a right is not a waiver of it.
26. Severance
26.1 If any provision is unlawful or unenforceable, it is severed and the remaining provisions continue in force.
27. Variation and non-reliance
27.1 We may update these Terms. The version in force when you book governs your Contract. Material changes will be notified where required by law.
27.2 Clause 2.2 (entire agreement and non-reliance) applies to Business Customers only and does not limit liability for fraud.
28. Governing law and jurisdiction
28.1 The Contract is governed by the law of England and Wales.
28.2 For Business Customers, the courts of England and Wales have exclusive jurisdiction. For Consumers, the courts of England and Wales have jurisdiction, but if you live in Scotland or Northern Ireland you may also bring proceedings in your home courts. Nothing in this clause removes protections you have under the law of the part of the United Kingdom where you live.
